THE STATE OF TEXAS, To the Sheriff of Jefferson County, GREETINGS:

WHEREAS Stephen R. Marble, on the 17th day of September, 1858 entered an action No. 314, in the District Court of said county, against William Phillips and Loring G. Clark, upon a promissory note for Two Hundred Dollars with Interest thereon, said note being dated April 11th, 1856, and signed “Phillips & Clark,” and affidavit having been made by the said Stephen R. Marble, that the said William Phillips is absent from this State so that the ordinary process of law cannot be served upon him:

You are therefore commanded to summon the said William Phillips, by publication of this Writ in the Galveston Weekly News, during four successive weeks previously to the return day hereof, to be and personally appear before our Honorable District Court, to be holden at Beaumont, in and for said county, on the 10th Monday after the 3rd Monday in September, A.D., 1858, then and there to defend said suit. Herein fail not.
(SEAL). Given under my hand and Seal of Office, at Beaumont, this 9th day of October, A.D., 1858.
